A will is legislated in the Qur'an, , and by scholarly consensus. An endowment (waqf) is a type of ongoing charity ( jariyah). A will cannot bequeath more than one-third of the wealth. It is not permissible to sell or own an endowment, nor is it permissible for heirs to include it in the inheritance and divide it. Therefore, it is not permissible to approve the sale of the endowed house. The brothers must be advised to fear Allah, return its price to their youngest brother, and make it an endowment as the father instructed.
