The conditions for a waqf are: that the endower must be the owner and legally competent to dispose of the property, that the endowed asset must be a known tangible entity, that the endowment must be for a purpose of righteousness and drawing closer to Allah, that it must be for a specific beneficiary, that it must be immediate and not contingent or temporary, and that the endower must not stipulate conditions that contradict its nature. If a house is written over to a person, it is a gift, not continuous charity. However, if it is written as a waqf that is not to be sold but its yield is to be benefited from, then it is a valid continuous charity, provided the endower is sane, mature, rational, and not coerced. As for a waqf contingent upon death, it falls under the ruling of a will, and it is not valid for an heir unless the rest of the adult heirs approve it.
