A condition for purchasing gold with money is that both commodities must be seized in the contracting session. The money can be seized physically, or constructively by being deposited into the seller's account. The gold can be seized physically by taking possession of the item itself, or constructively by being deposited into a special account belonging to the buyer, enabling him to take physical possession of the gold at any moment. There is no harm in the purchase if the bank acts as an agent for the buyer in taking possession of the gold, or if the bank owns the gold and constructive possession has occurred by its deposit into the buyer's account. Constructive possession is achieved by designating the gold bar and enabling the buyer to dispose of it, or by taking possession of a certificate representing ownership of a specific, identified bar, issued on the day of the contract, which entitles the buyer to take physical possession of the bar whenever he wishes.
