If the maternal aunt dies and has no children, and she is inherited by a sister and the sons and daughters of a brother, then the sister receives half as a prescribed share, according to the Almighty’s saying: “If a man dies, leaving no child but a sister, she will have half of what he leaves.” The male sons of the brother will inherit the remainder by ta’sib (agnatic inheritance) based on the : “Give the prescribed shares to those entitled to them, and whatever remains is for the closest male agnate.” There is nothing for the females. The sister’s half is divided among her heirs, and if the heirs are her children, it is divided so that the male receives the share of two females. If the maternal uncle dies before the maternal aunt, he does not inherit anything.
