Is it permissible for a father to stipulate in his will that his daughters be deprived of a portion of the inheritance, on the pretext that the value of this portion was borrowed from his male sons?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
It is not permissible for a man to make a will in favor of males to the exclusion of females, because a will for an heir is legally prohibited. The debt he owes his children must be paid from the estate before its division, so there is no need for a will concerning it. It is forbidden for a man to resort to deception to deprive females of their right to inheritance, because Islam abolished this pre-Islamic custom. "For men is a share of what the parents and close relatives leave, and for women is a share of what the parents and close relatives leave, be it little or much—a determined share."
