Is it permissible for a person who is unable to obtain a passport to perform Hajj for years to delegate another person residing in Makkah to perform Hajj Al-Islam or voluntary Hajj in exchange for money, and is it permissible to rely on residents of Makkah to perform Umrah for the deceased in exchange for money?

It is impermissible to perform Hajj or Umrah by proxy on behalf of another, for obligatory Hajj or Umrah, except for someone who is physically incapacitated, by consensus. As for supererogatory Hajj and Umrah, the Hanbalis permit deputizing someone to perform them on behalf of a capable person, while the majority of scholars forbid it.

When deputizing is permissible, the Hanbalis stipulate that the proxy must enter into ihram from the country of the one on whose behalf the ritual is being performed, while many scholars hold that entering into ihram from the miqat of the one on whose behalf the ritual is being performed is sufficient.

Performing Hajj and Umrah by proxy on behalf of the deceased is valid, by agreement of the scholars.
