What is the ruling of Islamic law regarding the continuation of marital problems and the family's refusal of reconciliation due to the husband's failure to pay the due maintenance?

1 min readAlso available in العربية

If the husband, despite his ability, does not spend on his wife and child, and the wife borrows from her father or her father spends on her intending to reclaim it from the husband, then the husband must pay her father what he spent reasonably. If a dispute arises, it should be referred to the Sharia court. If the husband desires reconciliation, it is preferable for the wife to return unless there is harm to her, and the father has no right to prevent her. If they do not reconcile, an arbiter from the husband's family and an arbiter from the wife's family shall intervene to bring about reconciliation or separation if reconciliation is impossible.
