Is it permissible for a man to contract a new misyaar marriage with his divorced wife after divorcing her with a single pronouncement while she is in her iddah, and is he required to obtain the permission of her guardians for this, and is it permissible for the Imam to be her guardian if her guardian does not know about or approve of misyaar marriage?

If a man divorces his wife with a single revocable divorce, he may take her back as long as she is within her waiting period (iddah). He is also permitted to marry a second wife before, after, or during the waiting period of the first divorce. He is not obliged to inform the first wife or seek her approval. A Misyar marriage is valid if it fulfills the conditions of a conventional marriage, namely the consent of the woman, the guardian (wali), two witnesses, and the dowry (mahr). There is no harm in the woman waiving some of her rights, but it must be with a guardian, as a marriage without a guardian is not valid.
