The maintenance of children is obligatory upon the father according to the Qur'an, , and scholarly consensus. Allah the Almighty says: (Then if they suckle for you, give them their due payment). And the Prophet, peace and blessings be upon him, said to Hind: "Take what suffices you and your child, in a reasonable manner." The people of knowledge have unanimously agreed on the obligation of a person's maintenance of their young children who have no wealth. Writing a covenant between the spouses to document this maintenance is permissible if they agree upon it, as a guarantee of the children's right, provided that the documentation is specifically for the children's maintenance, clothing, and housing.
