Is the questioner’s action of disposing of a plot of land she inherited in her name permissible, given her knowledge that the origin of this land was an endowment (waqf) that was purchased after the dissolution of endowments by the state, and that this transaction is considered unlawful, especially since she did not choose this plot herself, and with some relatives denying the land’s endowment status?

If it is proven that the aforementioned land is from the endowments (Awqaf) that the government confiscated without a legitimate interest or right, then it must be returned to the endowment; because an endowment cannot be sold, gifted, inherited, or disposed of except in a manner that serves its interest, based on the Hadith of Umar, may Allah be pleased with him, concerning endowments: "Its origin is not to be sold, inherited, or gifted."

However, if this is not proven, or if the government's disposition of the endowment and its sale were in its best interest, then there is no harm in owning it.

In the event that the ownership of the land is impermissible, the questioner has the right to claim her share from the heirs, due to the invalidity of the division, as Khalīl Al-Maliki said: "If the error or injustice is excessive, the division is annulled and restored to correctness."

It is advisable to consult scholars, pious individuals, and people of sound judgment in the country, as they are more knowledgeable about the circumstances and aspects of the matter, keeping in mind that the ruling of a ruler, the fatwa of a mufti, and the division of a divider do not make lawful what is unlawful for someone who knows it is unlawful, based on the Prophet's (peace be upon him) saying: "You bring your disputes to me, and perhaps some of you are more eloquent in presenting their arguments than others, so I rule in their favor based on what I hear. So, whoever I rule in his favor concerning something that belongs to his brother, let him not take it, for I am only cutting for him a piece of fire."
