What should a female pilgrim who has finished the Ifadah circumambulation and found a brown spot—knowing that it is the beginning of her menstrual period—refrain from among the prohibitions of ihram? And is she still in her state of ihram?

If the brown spotting is likely to have occurred either before or after the Tawaf (definition), the presumption is that it occurred after the Tawaf, and thus the Tawaf is valid. However, if you are certain that it appeared before or during the Tawaf, then if it occurred within your usual menstrual period and the total blood flow reached a day and a night, it is considered hayd (menstruation); otherwise, it is not. If the one you consulted for a fatwa (definition) ruled that it is hayd, then scholars agree on the impermissibility of sexual intercourse before the second tahallul (desecration), but they differ on touching and similar acts after the first tahallul and before the second. It is a precautionary measure for your husband to avoid touching you until you perform the circumambulation of the House and the Sa'y if it is required of you.
