It is permissible for a husband to take back his divorced wife during her 'iddah (definition) (waiting period) without the need for witnesses or her consent, or the consent of her guardian, according to the majority of scholars. However, if the husband claims to have taken her back after the 'iddah has expired, and the wife denies it, he is not to be believed unless there is evidence (two witnesses), and her statement is accepted. If the wife confirms his claim, the رجعة (return to marriage) is established according to the majority of scholars, with the exception of the Malikis who hold that the رجعة is not established in this case even if the wife confirms it. Therefore, it is more cautious to renew the marriage contract to avoid this difference of opinion.
