Is it permissible to seek divorce from a husband who stipulates that his wife imagine other men, including his brothers, during marital relations, and who is negligent regarding her mixing with them, and does not observe her marital rights, knowing that he is not remiss in the daily living expenses and shows her his love?
If a husband imagines his wife committing adultery and is content with her mingling with strangers, this indicates that he is a dayyuth, and a dayyuth is one who has no protective jealousy over his family. His being neglectful in the side of Allah makes him untrustworthy regarding his wife's rights. It is the wife's right that her husband keeps her chaste and satisfies her natural urges. This immoral behavior from the husband permits the wife to seek divorce, but she must first advise him and remind him of Allah. If he does not repent, there is no good for her in remaining with him.
