The wife's maintenance is a religious obligation upon her husband, and he must provide it even if it is not requested from him. If he falls short in this, then what has passed remains his liability unless the wife pardons him. This shortcoming is a great sin, for the Prophet, peace and blessings be upon him, said: "It is sufficient sin for a man to neglect those whom he is responsible to feed." It is advised to inform the husband of his obligation to provide maintenance and to demand it from him in a gentle manner. If he remains obstinate, it is permissible to refer the matter to whoever can compel him to pay it, including resorting to the judiciary.
