If there was no legal privacy ( khalwa shar'iyya ) between the spouses, the wife is entitled to half of the agreed-upon mahr. However, if legal privacy did occur (the spouses were alone together after the marriage contract), the wife is entitled to the full mahr, and this is the view of the majority of scholars. Divorce occurs when the husband pronounces it, without the condition of it being in front of a court, and there is no expiation (kaffara) due from the husband.
