A 45-day-old fetus has not yet had the soul breathed into it, and scholars differ on the ruling concerning its abortion. The Hanafis, Shafi'is, and some Hanbalis permit its abortion without requiring blood money (diyah) or expiation (kaffarah). The Malikis and some Hanafis, Shafi'is, and Hanbalis prohibit it absolutely. According to this view, blood money and expiation are obligatory. The blood money is one-tenth of the mother's blood money, to be paid by the mother from her own wealth, and she does not inherit from it. Expiation is recommended by the Malikis (freeing a believing slave or fasting for two consecutive months) and is not obligatory for the Hanbalis if the embryo has not yet taken on a discernible form (mudghah).
