What are the rights of a divorced or Khul'-divorced woman? Is she entitled to housing with her children? Is she considered unjust to her children if she seeks divorce due to incompatibility and the absence of affection and mercy? Should a woman endure for the sake of her children despite her aversion to her husband and her inability to fulfill his rights, or should she separate from him to avoid sin?

A woman who is revocably divorced is entitled to maintenance and lodging as long as she is in her iddah (waiting period). A woman who is irrevocably divorced is not entitled to maintenance or lodging, unless she is pregnant. As for the children, their maintenance and lodging are the responsibility of their father.

Regarding the request for divorce, do not hasten, especially if there are children. Consult trustworthy people and seek Allah's guidance through istikharah. Frankness and honesty can resolve disputes, and it is possible to offer the husband materials about good marital conduct.
