What are the legitimate rights of a divorced wife who has custody of children, and do they include a monthly allowance for her and housing?
The wife has a right to be financially supported by her husband, a mandatory duty according to his capability, unless she is disobedient (nashiz). This includes maintenance and housing. A woman divorced with a revocable divorce (ṭalāq rajʿī) is entitled to maintenance and housing as long as she is in her waiting period (). A woman divorced with an irrevocable divorce (ṭalāq bā’in) who is pregnant is entitled to maintenance and housing. After the iddah ends, a divorced woman is not entitled to maintenance or housing, except during the period of pregnancy or breastfeeding. If a woman divorced with an irrevocable divorce has children in her custody, scholars differ on the obligation of housing her, but they agree on the obligation of maintenance and housing for the children.
