Is it permissible for a girl's brother to solemnize her marriage contract if her father refuses her marriage to a young man whom she wishes to marry and refuses anyone else?

The original principle is that the father is the guardian (wali) of his daughter, and it is not permissible for anyone else to marry her off without his permission. The father should not refuse to marry off his daughter except for a legitimate Shar'i reason. An attempt can be made to convince the father through mediation by someone whose word is hoped to be acceptable to him, along with abundant supplication. If the father insists on refusing, the girl has the right to refer the matter to the Shar'i court so that the judge may marry her off if it is proven to him that her guardian is preventing her marriage (ʿaḍl). If marriage becomes impossible, do not despair, for goodness may lie elsewhere, "And perhaps you hate a thing and it is good for you; and perhaps you love a thing and it is bad for you. And Allah Knows, while you know not."
