If the shepherd is not an agent for the sheep owners in disposing of them, and if custom does not permit the ram to impregnate the sheep of others, then he is not allowed to impregnate the sheep with the ram without the owner's permission. Selling the ram's semen (i.e., taking compensation for its stud service) or leasing the ram for stud service is considered unlawful by the majority of scholars, due to the Prophetic prohibition, and because it is a contract over something that cannot be guaranteed for delivery, as it depends on the ram's choice, and what is intended from it is semen, which is unknown. However, some have permitted it due to necessity.
