Must I be patient with my stingy and selfish husband who does not provide for me and my son, insults my family, and has made me hate my home and living with him, all for the sake of social appearance and raising my son, or do I have the right to seek a divorce?
The husband must spend on his wife and children equitably and provide them with housing. If he fulfills his obligations, the wife has no right to demand more than that. However, if he falls short in providing maintenance, he is sinful, and the wife is permitted to take from his wealth what suffices her and her children equitably, even without his permission. The wife is advised to counsel him and remind him of her right. If he insists on his dereliction, she has the choice between patience or seeking divorce. Patience, along with counsel, is preferable, and there is no sin in seeking divorce. It is also advised to seek guidance from Allah (istikharah) and consult those whose opinions are trusted.
