Is purchasing a property with the assistance of a bank, according to its conditions which include official mortgage, property valuation by bank experts, that the value of the mortgaged property not be less than 125% of the debt value, in addition to insuring the property against fire, considered something that angers Allah Almighty?
To purchase real estate with bank assistance, there are two scenarios:
Scenario 1: The bank loans you the value of the property. This has two possibilities: 1. If the loan is a good loan () with no interest, then there is no harm in it. The bank's request for a mortgage to guarantee repayment is permissible, provided it does not lead to something forbidden, such as commercial insurance, which is forbidden, whereas Islamic insurance is permissible. The questioner's intent regarding the phrase "after recovering 10% of the land value against fire" must be clarified. 2. If the loan is with interest, it is usury (riba), which is forbidden by Islamic law. There are severe texts that forbid it and threaten those who consume it.
Scenario 2: The bank buys the property for itself and then sells it to you for a profit (Murabaha). This transaction is generally permissible, and it has rules and conditions mentioned in previous fatwas.
