Is a wife's supplication against her husband's family and her refusal to visit them considered a legitimate Shar'i reason for divorce? The questioner is advised to supplicate frequently with sincere desire and hope, for Allah has commanded supplication and promised to answer it. It does not appear that there is a legitimate Shar'i reason for the wife to request divorce, and the general rule is that requesting divorce is forbidden except for a legitimate Shar'i excuse. The wife has no right to prevent the father from seeing his children. Custody is a right for both spouses as long as the marriage exists. If a divorce occurs, custody is for the mother unless she remarries, and the father's right to visitation is not abrogated. If the mother's custody is forfeited, custody transfers to the one who is most entitled to the children after their mother. For the father to be entitled to custody, there must be a suitable female for custody. The rights of the divorced woman are legally recognized. If the divorced woman is disobedient (nashiz), she has no right to maintenance unless she is pregnant. It is advised to strive for reconciliation between the spouses and to involve wise individuals, and for them to make respect and fulfilling rights the basis of their interaction.
