The auction contract (bid contract) is valid and permissible if it fulfills the Sharia conditions. The resolution of the Islamic Fiqh Academy states the following:
1. The auction contract (bid contract) is a compensatory contract that relies on inviting interested parties to participate in the auction and is concluded upon the seller's consent. 2. The auction contract varies according to its subject matter (sale, lease) and its nature (voluntary, compulsory). 3. The procedures followed in auctions must not contradict the rulings of Islamic Sharia. 4. Requesting a guarantee from those who wish to enter the auction is permissible according to Sharia, and it must be returned to every participant who was not awarded the bid. 5. There is no Sharia impediment to collecting an entry fee with a value that does not exceed the actual cost. 6. Najash (deceptive bidding) is forbidden. Its forms include increasing the price of a commodity without the intention to buy, falsely praising a commodity to entice buyers, falsely claiming a certain price, or using modern deceptive methods to raise the price or mention unreal descriptions.
