What is the ruling on the Hajj of one who had sexual intercourse with his wife after stoning Jamrat al-Aqabah and shaving his head, but before the Tawaf al-Ifadah? Does a دم (sacrificial offering) become due as a result, and where should the fidyah (expiatory offering) be slaughtered if it becomes obligatory?

If someone has intercourse with his wife after the first Tahallul (partial desacralization) and before Tawaf al-Ifadah (circumambulation of outpouring), his Hajj is not invalidated, but he has committed a sin for which he must repent and seek forgiveness. He must also go out to the Hill (area outside the Haram) to re-enter Ihram (sacred state) and perform Tawaf al-Ifadah. Furthermore, he must slaughter a sheep to be distributed among the poor of the Haram, and he must not eat anything from it. If his wife was also in Ihram and consented to the act, she is liable for the same as he is; but if he forced her, then there is no penalty upon her. The jurists have agreed that intercourse after the first Tahallul does not invalidate the Hajj. The Hanafis, Shafi'is, and Hanbalis held that a sheep is obligatory, while Malik, and according to one opinion among the Shafi'is and Hanbalis, mandated a camel. Malik and the Hanbalis also stipulated that whoever has intercourse after the first Tahallul and before Tawaf al-Ifadah must go out to the Hill and perform an Umrah (minor pilgrimage). If he does not go out to the Hill to renew his Ihram, his Tawaf is valid, but he owes a fidyah (expiation).
