Is a man sinful if he has intercourse with his wife who has not yet entered a state of Ihram, while she is in Jeddah to perform the Hajj obligation, and what is the ruling on that?

Anyone passing a Miqat with the intention of Hajj or Umrah must enter into ihram from it. If a woman intended Hajj and passed the Miqat, then her husband had intercourse with her in Jeddah, her Hajj is invalidated by scholarly consensus. She must continue with this invalidated Hajj, then perform a make-up Hajj, and sacrifice a camel (badanah) during the make-up Hajj. However, if she did not intend to enter ihram when passing the Miqat, and her husband had intercourse with her before she entered ihram, then there is no blame on either of them. As for one who neglects to enter ihram from the Miqat, he must sacrifice a sheep to be distributed among the poor, unless he returns to the Miqat and enters ihram from it.
