This is because the preponderant opinion is that whoever commits a prohibited act while in the state of ihram out of forgetfulness or ignorance bears no responsibility, based on the words of Allah Almighty: "Our Lord, do not take us to task if we forget or make a mistake." It has been reported from Ibn 'Uthaymin that whoever commits a prohibited act out of ignorance, forgetfulness, or compulsion bears no responsibility, and none of the rulings pertaining to intercourse apply unless the person was aware, mindful, and not compelled.
