The employee is a private hire whose services the employer owns only during official working hours. There is no harm in him working outside official working hours, and he is not obligated to fulfill a condition that prevents him from doing so, because the Prophet, peace and blessings be upon him, said: "What is wrong with men who stipulate conditions that are not in the Book of Allah? Whoever stipulates a condition that is not in the Book of Allah, it is void, even if it be a hundred conditions. The Book of Allah is more worthy, and the condition of Allah is more binding."
