Observing the truth and avoiding falsehood. 2. That the litigation be before a court, if one exists, or before a conventional court if no Sharia court exists, or if the client finds no means to obtain his right except through it, or if the lawsuit was filed against him in it.
As for paying money inside the court, if it is for the lawyers, then it is a fee for agency and not a bribe. But if it is for others, then it is a forbidden bribe for both the giver and the taker, unless it is the only way to obtain a right, in which case it is permissible for the giver and forbidden for the taker.
