A marital life thrives when each party knows and fulfills the rights of the other, and when they treat each other with kindness. The cause of discord is often that one spouse demands their rights without giving the other their due, or falls short in doing so, or fails to overlook shortcomings and instead focuses on flaws. Not every disagreement leads to divorce; rather, divorce occurs when marital life becomes impossible and discord becomes deeply entrenched and irreparable. When a wife shows defiance (nushooz), the husband must follow what Allah has commanded: first admonition, then abstention from conjugal relations, then a non-brutal beating. If the discord persists, two arbiters, one from each family, should be sent to seek reconciliation. If all attempts at reconciliation fail, and the discord becomes entrenched, and the two arbiters deem separation to be better, then divorce is more beneficial at that point.
