If the uncle is still wealthy with his properties, then it is not permissible to give him unless he is a debtor who is entitled to it. However, if he only owns a dwelling that suits his condition, then zakat is permissible for him. But if the dwelling is luxurious, then zakat is not permissible for him; rather, he must sell it and buy a dwelling that suits him, and benefit from the remainder, according to the Prophet's (peace be upon him) saying: "Charity is not permissible for a wealthy person except in five cases," and "Charity is not permissible for a wealthy person, nor for one who is strong and able-bodied."
