Is it permissible to change a piece of land endowed by a grandfather as a cemetery for his family into a road that serves the villagers to facilitate the transportation of the sick and elderly, considering this an ongoing charity (Sadaqah Jariyah)?

Changing or replacing an endowment requires referring to the Sharia (definition) judge to examine the endowment and the extent of the need, as it is not permissible to dispose of endowed land by sale or exchange except if it serves the interest and benefit of the endowment. This must be done through the Sharia judge. If the disposer is not the supervisor of the endowment, he is not permitted to dispose of it except through the supervisor.
