Is it permissible to transfer an endowment land (Ard As-Sabil) dedicated by a person who died hundreds of years ago, or its income, to the village mosque, or to divide its proceeds between the community council (Al-Majlis) and the mosque, knowing that the visitors to the council are very few and incur no expenses?

What exceeds the needs of the council from the land's revenue should be spent on a similar entity to what the endower specified, such as another council or a guesthouse that benefits travelers, because the surplus cannot be spent on the current council, nor is it permissible to render it idle. This is closer to fulfilling the endower's intention for the endowment. This is supported by the practice of spending the surplus from the endowment's revenue on a similar entity to the one endowed, as 'Ali (may Allah be pleased with him) did when there was a surplus from freeing slaves by contract, and he spent it on other slaves under contract. If it is not possible to spend it on an entity similar to that one, then there is no harm in spending it on the village mosque or on the poor and needy, with priority given to the endower's poor relatives.
