What is the ruling on benefiting from gardens that were once common land for everyone, and then landowners seized them?

If the trees and lands are their property, then they have the right to dispose of them as they wish. Nothing is obligatory except what has been enjoined regarding zakat on crops after harvest – if the fruits of the trees are among those subject to zakat. It is better for them to give charity from it and to give gifts to others.
