Does divorce take effect on my brother who swore to divorce if his cousin opened a window in his ground-floor house, and he did open it? And what is incumbent upon him, knowing that he resides in Saudi Arabia and wishes to travel?

If a brother swears by divorce concerning the closing of a specific window, contingent on his cousin opening it, it is possible that he specified a time limit for this. In such a case, the oath would expire once that time limit has passed. Alternatively, he may not have specified a time limit. In this scenario, his wife remains under his marital bond, and the divorce does not occur unless it becomes impossible to close the window, such as in the event of his death. The majority of scholars hold that divorce occurs if the window is not closed. However, Sheikh al-Islam Ibn Taymiyyah is of the view that an expiation for breaking an oath (kaffarat yameen) is required if he did not intend divorce.
