Divorce does not take effect except through an explicit utterance from the husband, or an implicit statement accompanied by intention. Writing the divorce is considered an implicit statement, so it does not take effect unless there is an intention to divorce. If the husband writes the divorce without intending to effect it, it does not take effect. However, if he utters an explicit divorce statement, such as "My wife is divorced," the divorce is effective even if he did not intend it. If the state grants financial aid after divorce, it is not permissible to resort to deception to obtain it if the divorce has not actually occurred, and the condition of the granting authority must be observed.
