Is it permissible to marry a girl if the mother claimed to have breastfed her once previously, then she returned and claimed to have breastfed her more than five times after an engagement that lasted two years, knowing that the suitor does not believe her?
Scholars have differed regarding the acceptance of a single nursing woman's testimony to prove the prohibition [of marriage due to fosterage]. The majority of scholars hold that it is not accepted, contrary to the Hanbalis, who accept it on the condition that the woman be "pleasing" (مرضية); meaning, characterized by truthfulness and uprightness. If the woman declares that the suckling was less than five رضعات (sucklings), and then retracts and swears falsely, her testimony is invalidated, and the prohibition is not established. It is obligatory for a man to obey his mother in refraining from marriage, unless he fears falling into disobedience of Allah Almighty.
