What is the ruling on one who swore not to return home unless the birds were sold, then returned after being falsely informed that they had been sold?

If your brother swore not to return home unless the birds were sold, and then he returned believing they had been sold, he does not break his oath (does not commit hanth). However, if he knew of their presence and remained in the house, he would break his oath. This is similar to someone who does something sworn upon, while being forgetful or ignorant; he does not break his oath, because his oath remains. But if he does so intentionally or after knowing of the birds' presence, he breaks his oath and expiation (kaffarah) becomes due upon him. Lying is absolutely forbidden, and repentance from it is obligatory.
