Allah has legislated marital life to achieve many purposes, one of which is to have children, and this is a right for both spouses. The wife should advise her husband to stop smoking due to its prohibition and its harm to the body and to others. If he does not respond, she has the right to seek divorce, or khul' (dissolution of marriage initiated by the wife), or to be patient. It is recommended for the woman to perform Istikhara (prayer for guidance) and consult with wise people. Khul' is permissible if the wife dislikes her husband's character, or his physical appearance, or his lack of religious commitment, such as his negligence in congregational prayers or his smoking.
