Is it permissible to sell with deferred payment and deferred delivery?

1 min readAlso available in العربية

Postponing the price and the item sold has several forms: one of them is selling a described commodity that is a liability for a deferred price, which is initially called debt for debt. This is prohibited by consensus, except among the Malikis, who permit a short deferral (such as two or three days). Another form is selling a specific commodity for a deferred price, while also postponing the delivery of the commodity. The ruling for this form is permissibility, provided the commodity is not among the usurious items for which immediate possession is stipulated. The permissibility of this form is indicated by the hadith of Jabir's camel. The Hanbalis held the view that it is valid for the seller to stipulate the usufruct of the sold item for a known period. This entails postponing the delivery of the sold item, and they also used the hadith of Jabir's camel as evidence.
