The answer

Not everyone who is killed is a martyr. One who is killed while being an oppressor is not a martyr. However, one who is killed unjustly in defense of his soul, property, honor, or religion, or in jihad in the way of Allah, is a martyr. As for one who is killed by mistake, we cannot definitively say he is a martyr. A martyr is forgiven for all sins except debt. If one is killed while drunk, and he was an oppressor, then it is darkness upon darkness. If he was wronged, we hope he is a martyr. If he was killed by mistake, then he is not a martyr. It has been said: "Do not be in a state that you would hate for death to come to you in."
