Is insuring the transfer of a deceased's body to their home country considered unlawful (haram), given the necessity of the transfer to avoid cremation in the West?
Commercial insurance is forbidden by Sharia. However, if the cremation of deceased Muslims' bodies in a non-Islamic country is a reality, and their transfer is only possible at an exorbitant cost beyond the means of the responsible party, then there is no harm in subscribing to commercial insurance for the sake of this necessity, based on the Almighty's saying: "And He has enumerated for you what He has forbidden to you, except for that to which you are compelled" (Al-An'am: 119). But once the necessity ceases, or if it can be addressed by permissible means, then subscribing to the forbidden insurance becomes prohibited.
