What is the ruling on dividing inheritance after the death of the mother, knowing that the original property belonged to the father who passed away more than forty years ago? And are the apartments that the children built with the mother's permission considered part of the inheritance, and how is each heir's share calculated?

The plot of land and the building on it belonging to the mother is an inheritance for everyone. It should be appraised at its current value and divided among the children, with the male receiving the equivalent of two females' shares, in accordance with the verse: "Allah instructs you concerning your children: for the male, what is equal to the share of two females."

As for what the children built with their own private money on the land, it is their private property and does not enter into the division of the inheritance if the heirs agree to their ownership of the land and they are mature and adult. Otherwise, they are entitled to the value of the building as demolished materials, and everything reverts to the inheritance, and those who built are entitled to the value of the building as demolished materials.

If the heirs agree on a method of dividing the inheritance that satisfies them all, there is no religious impediment, provided they are mature and adult. It is advisable that the reference for issues of dispute and common rights be the Sharia court for resolution.
