Does the questioner inherit his share and his mother's share from the estate of his deceased father, in light of his brothers' attempt to delay the division of the inheritance, and how is the legal distribution carried out?

The father's estate is divided such that the wife receives one-eighth due to the presence of children, as Allah Almighty says: "But if you have a child, then for them [i.e., the wives] is one-eighth of what you leave, after any bequest you [may have] made or debt." The remainder is divided among the sons and daughters, "with the male receiving the share of two females," as Allah Almighty says: "Allah instructs you concerning your children: for the male, what is equal to the share of two females."

The money is distributed into 104 shares: 13 shares for the mother, 7 shares for each daughter, and 14 shares for each son.

If the mother dies and has no children other than you, you receive half of her estate, as Allah Almighty says: "And if there is only one daughter, she will have half." The remainder goes to her closest male agnates ( asabah ), based on the Hadith: "Give the prescribed shares to those entitled to them; then whatever remains is for the nearest male relative."

It is necessary to consult the Sharia courts regarding inheritance matters to ensure justice and safeguard rights.
