Is zakat obligatory upon the broker who buys and sells used cars, lands, and houses, and does he pay zakat for each sale operation or upon the passing of a hawl (a lunar year), according to the Maliki school of thought?
The view of the majority of scholars is that newly acquired wealth begins a new lunar year for purposes, unless it is a growth from existing wealth, such as trade profits or offspring of livestock, in which case it is zakatable along with its origin. So, if a person acquires new wealth, Zakat is not obligatory on it until a full lunar year has passed from the date of its possession, provided that it reaches the (minimum threshold) either by itself or by being combined with other wealth he owns. However, if the original wealth had reached the nisab before the new wealth was acquired, the newly acquired wealth is not zakatable with the Zakat of the original wealth; rather, it begins a new lunar year. Zakat is obligatory on trade goods and the profits generated from them upon the completion of a lunar year, provided they reach the nisab. Scholars have differed regarding the permissibility of paying Zakat in advance of its due time: Malik held the view that it is not permissible except for a small amount, while the majority of scholars permitted it.
