If the brokerage condition was the attainment of mutual consent and the leasing of what he guided to, and this was not fulfilled, then some scholars are of the opinion that he is not entitled to a fee because his work was not completed. Others believe that he is entitled to the value of his relative effort if it was benefited from, and this is the more preponderant view, in order to preserve the broker's right. It is permissible for the broker to take his fee from one party or from both parties, according to the agreement.
