What is the religious ruling regarding the husband's statement: "By the three divorces, you are not going to your mother's or to my mother's," and does divorce occur if she goes, and is marital intimacy forbidden?

If a husband made his wife's triple divorce conditional on her visiting her mother or his mother, the solution is for her not to visit either of them. If the wife visits either of them, a triple divorce occurs according to the majority of scholars, and this is the relied-upon view. Cohabitation then becomes forbidden until she marries another man and he divorces her after consummation.

Shaykh al-Islam Ibn Taymiyyah holds that the husband must pay an expiation for breaking an oath if he did not intend divorce. If he did intend divorce, then a single divorce takes effect, and he may take her back if this does not complete the third divorce. The husband cannot retract this conditional divorce according to the majority of scholars, whereas Shaykh al-Islam Ibn Taymiyyah permits retraction if divorce was intended.

The fatwa is issued according to the view of the majority, which is that retraction from the condition is not possible. If the condition occurs, then it results in an irrevocable divorce (al-bainunah al-kubra), unless the reason for which the husband swore ceased to exist, or he had an intention that specified his wording.
