If the dwelling is independent and suitable, the wife has no right to refuse to live in it; otherwise, she is considered disobedient (nashiz). In such a case, the husband is permitted to pressure her to seek a khul' (divorce initiated by the wife) in exchange for relinquishing some of her rights. However, if the dwelling is unsuitable or she is exposed to harm in it, she has the right to refuse to live there, and the husband is not permitted to harm her to make her redeem herself from him. If the husband divorces her without the condition of relinquishing any of her rights, he must pay the deferred dowry (mu'akhkhar al-sadaq) and all other rights of a divorced woman. The difference in the wife's age from what was stated before marriage has no effect. It is advisable to involve benevolent people to mediate reconciliation, as divorce is the last resort.
