Some jurists have stipulated that the guardian's description of the wife as free from defect before the contract takes the place of the husband's stipulation of that, and in such a case, the husband has the right to request the annulment of the marriage and can claim the dowry from the one who deceived him, provided that the husband was not aware of this defect before the contract or knew about it and acted in a way that indicated consent. If the girl's father described her condition contrary to reality, the husband has the option, and he may divorce her, but he does not have the right to claim the dowry from her guardian in this situation.
