The Salaf differed concerning the ruling on one who abandons prayer. Some of them held that he is a disbeliever and an apostate, and consequently, his marriage is annulled. This is the view of Imam Ahmad. Others held that he is an evildoer (fasiq) but not a disbeliever. This is the view of Malik, Al-Shafi'i, and the majority of jurists, and consequently, it is permissible to remain with him if there is hope for his repentance. If he persists in abandoning it, the wife may refer her case to the Sharia courts.
